Terms Of Service

These terms apply when you use thewackywhale.com or join The Pod, our paid membership (together, the "Service"). By using the Service you agree to them. If you don't agree, don't use the Service.

1. Education Only

The Service provides general trading education and calculation tools. It is not investment advice and is not tailored to you. Please read our Risk Disclosure, which is part of these terms. You must be at least 18 years old to use the Service.

2. Your Account

You sign in with a one-time code sent to your email. Keep access to your email secure; anyone who can read it can sign in as you. Accounts are for one person. Don't share access or resell any part of the Service.

3. Membership, Billing And Renewal

The membership costs $29 per month or $249 per year, in US dollars, as shown at checkout.
Your membership renews automatically at the end of each billing period, and we charge the payment method on file, until you cancel.
You can cancel any time from your account page using Manage Billing. Cancellation stops future renewals. You keep access until the end of the period you already paid for.
For yearly plans, we email you a reminder 15 to 30 days before each renewal with the date and amount.
If we ever change the price, we'll email you before the change applies to your next renewal, and you can cancel before then.
Refunds are covered by our Refund And Cancellation Policy.

4. Acceptable Use

Don't copy, scrape, republish or sell our lessons or tools; don't try to break, overload or get around the Service's security; and don't use it for anything unlawful. We may suspend or end accounts that break these rules.

5. Your Content

Trades and notes you put in your journal belong to you. You let us store and process them only to run the Service for you. You can export them as a CSV file at any time.

6. Our Content

The lessons, tools, design and brand are owned by The Wacky Whale and protected by law. Your membership gives you a personal, non-transferable right to use them while you're a member.

7. No Warranties

The Service is provided "as is" and "as available." We work to keep the lessons and calculators accurate but don't promise they are error-free, uninterrupted or right for your purposes. Check important numbers yourself before you rely on them.

8. Limitation Of Liability

To the fullest extent the law allows, The Wacky Whale is not liable for any trading losses or for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

9. Changes

We may update these terms. If a change is significant, we'll tell you by email or on the site before it takes effect. Continuing to use the Service after that means you accept the new terms.
